Texas Bankruptcy Exemptions

The bankruptcy laws in Texas gives you the choice of choosing the federal exemption statutes or the Texas exemptions.

The following is a list of items you can keep if you choose the federal exemption:

  • Your home
  • Life insurance payments
  • Life insurance policy with loan value
  • Un-matured life insurance contract
  • Alimony
  • Pensions and retirement benefits
  • household goods up to a total of $10,775
  • Health aids
  • Jewelry up to $1,350
  • Lost earnings payments
  • Motor vehicle up to $3,225
  • Personal injury compensation payments up to $20,200
  • Tools of trade up to $20,200
  • $1,075 of any property plus up to $10,125 of any amount of unused homestead exemption

The following is a list of items you can keep if you choose the Texas exemption:

  • Your home
  • $30,000 worth of personal property ($60,000 for head of family)
  • Burial plots
  • Health aids
  • Unemployment, disability, veterans', workers' compensation and Social Security benefits
  • Alimony and child support
  • Retirement plan and life insurance proceeds
  • Business partnership property
  • Farming or ranching vehicles and implements

Clerk’s Office
The Clerk’s Office provides general office information such as office locations and hours, clerk’s notices, employment and federal holidays. You also have access to search archives and city and county records. Copy requests and transcript and tape orders can also be made through the Clerk’s Office.
